Crisco® Grill-A-Day Giveaway Promotion ("Promotion")
OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. HOW TO ENTER: Look for a Universal Product Code ("UPC") found on participating Crisco® products (Crisco Cooking Oils, No-Stick Sprays, Shortenings or Shortening Sticks). To obtain a UPC without purchase, simply write down the UPC from any participating Crisco product listed above at a retail location or any other location. You may enter for a chance to win beginning 12:00 p.m. (noon) Eastern Time (ET) 6/19/08 until 11:59 p.m. ET 9/26/08 ("Promotion Period") by going to www.crisco.com/grilling, completing the entry form, including name, address, city, state, ZIP, telephone number, e-mail address and birth date, and following the directions to enter your UPC. If you are a returning player, proceed to the returning player log-in page and enter your first name, last name and e-mail address and follow the directions to enter your UPC. If after entering your UPC you are selected at random as a daily prize winner, a congratulatory message with prize description will be instantly displayed. When prompted, winners must confirm the information provided on their entry form to claim a prize. Failure to do so will result in prize forfeiture. The J.M. Smucker Company ("Sponsor") is not responsible for any valid UPC which is defective, and Sponsor's sole liability is limited to replacement with one UPC. Limit one game entry per person or e-mail address per day during the Promotion Period. Any attempt by any entrant to obtain more than the stated number of entries using multiple/different e-mail addresses, identities, registrations and logins, or any other methods will void such entries and that entrant may be disqualified. Use of any automated program to enter will result in disqualification. E-mail addresses submitted will be used for Promotion playing purposes only and will not be published or used for any other purpose.
2. GRAND PRIZE DRAWING: Each time you enter the Promotion during the Promotion Period, you will receive an automatic entry into the Grand Prize Drawing. On or about 10/10/08, a random drawing will be held to select the potential Grand Prize winner from among all eligible entries received. The drawing will be conducted by an independent judging agency, whose decisions will be final and binding in all matters pertaining to the Grand Prize Drawing. The potential Grand Prize winner will be notified by email, phone and/or mail on or about 10/13/08.
3. VERIFICATION: All potential winning entries are subject to verification by the Sponsor, or an independent Promotion Administrator ("Administrator") whose decisions are final and binding. An entrant is not a winner of any prize, even if the Promotion should so indicate, unless and until entrant's eligibility and the potential winning entry has been verified, entrant has complied with the terms of these Official Rules and entrant has been notified that verification is complete. The Sponsor will not accept screen shots or other evidence of winning in lieu of its validation process. Any entry that occurs after the system has failed for any reason is deemed a defective entry and is void and will not be honored.
4. PRIZES & ODDS: 100 Daily Prizes: Coleman® RoadTrip® LE Grill. Approximate Retail Value ("ARV"): $174. One Grand Prize Drawing Grand Prize: One Backyard Makeover awarded in a $10,000 check, plus a Coleman® Series 8200 Gas Grill. ARV: $11,399. Total ARV of all prizes: $28,848. All prizes must be claimed by 12/31/08. Odds of winning a daily prize will depend on the number of entries received, the order in which they are received and the order in which daily prizes are randomly distributed. Administrator will determine at random by computer-generation the order in which the daily prizes will be awarded throughout the Promotion. Odds of winning grand prize depend on number of eligible entries received in the Promotion. Limit one daily prize per e-mail address, person or household. Prizes are not transferable. No prize substitutions permitted, except by Sponsor, who may substitute a prize of equal or greater value if advertised prize becomes unavailable. Unclaimed prizes will not be awarded.
5. ELIGIBILITY: The Promotion is open to legal residents of the 50 United States and D.C., 18 years of age or older. Employees, officers and directors of Sponsor, Promotion Mailing Center, Inc., their respective parent companies, affiliates, subsidiary companies, distributors, sales representatives, retailers, advertising, sales promotion and judging agencies and all other service agencies involved with the Promotion and all of their respective immediate family members (parent, child, sibling and spouse) or household members (whether or not related) of any of the above are not eligible. Void outside the 50 United States and D.C. and where prohibited. All federal, state, and local laws and regulations apply. By entering, entrant (and entrant's parent/legal guardian if entrant is a minor in his/her jurisdiction of residence) agrees to these Official Rules.
6. GENERAL TERMS & CONDITIONS: Allow up to 12 weeks for shipment of prizes following verification. If any Promotion prize notice or Promotion prize is returned as undeliverable, prize will be forfeited. By participating in the Promotion, entrant (or his/her parent or legal guardian if entrant is a minor) agrees to release, hold harmless and indemnify Sponsor, Promotion Mailing Center, Inc., their respective parent companies, affiliates, subsidiary companies, distributors, sales representatives, retailers, advertising, sales promotion and judging agencies and the employees, directors, officers and agents of each from and against any and all liability whatsoever for any injuries, losses, harm, damage (including but not limited to property damage, personal injury and/or death), claims, actions, costs and expenses (including without limitation, all attorney's fees and court costs) (collectively, a "Loss") arising directly or indirectly from or in connection with his/her participation in the Promotion, acceptance, possession or use/misuse of the prize or participation in any prize-related activity. Entrant further acknowledges that the above parties are in no manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Acceptance of prize shall further constitute and signify the winner's agreement and consent (or that of parent or legal guardian if winner is a minor) that Sponsor may use the winner's name, likeness and/or prize and biographical information worldwide for promotion purposes without limitation and without further compensation, except where prohibited. Winners' statements and information may be used in whole of in part and may be paraphrased, amplified, shortened and/or put into conversational form to meet the requirements of copy, layout and/or script provide that their general sense is not changed. Winners (and a winner's parent or legal guardian if winner is minor) may be required to complete, execute and return an Affidavit of Eligibility, Liability Release, and where lawful, a Publicity Release within 14 days of receipt of those documents. If documents are not returned timely, or if any notification or prize is returned as non-deliverable, or if a winner of any prize is found to be ineligible or not in compliance with these Official Rules, such prize may be forfeited and awarded to an alternate winner. Winners are solely responsible for any local, state, or federal taxes on prizes. Sponsor reserves the right to take such action as it deems necessary to enforce these Official Rules and ensure the fair operation of the Promotion, including without limitation, barring and disqualifying entrants who do not comply with these Official Rules. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Promotion if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes in a random drawing from among the eligible entries received up to the time of the impairment or take such other action deemed fair and equitable by Sponsor. Sponsor reserves the right to award only the number of prizes stated in these Official Rules for that category. No more than the number of prizes stated in these Official Rules will be awarded. If due to a production or other error, more prize winners are identified than are intended to be awarded at any prize level as stated in these Official Rules, such prizes will be awarded in a random drawing from all such verified prize claims received for such prize level. All entries and requests become property of Sponsor.
7. LIMITATIONS OF LIABILITY: In the event of a dispute regarding the identity of an entrant, such entry will be deemed to be made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Neither Sponsor nor its agencies are responsible for lost, late, stolen, illegible, misdirected, or non-delivered entries or e-mail; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in the Promotion and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Website. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of the Promotion or Website, may be acting in violation of the terms of the Website or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Any attempt to deliberately damage any Website or undermine the legitimate operation of the Promotion is unlawful and subject to legal action by Sponsor or its agents.
In no event will Sponsor, its affiliates, subsidiaries and related companies, their advertising or promotion agencies or their respective officers, directors, employees, representatives and agents be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and use of the Promotion Internet site or downloading from and/or printing material downloaded from said site. Without limiting the foregoing, everything on this site is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties, so some of the above limitations or exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions.
8. DISPUTE RESOLUTION/CHOICE OF LAW: By entering, entrants (and entrants parent/legal guardian if entrant is a minor) agree that all issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion (including, but not limited to, any issues or questions concerning the acceptance, possession or use/misuse of the prize or participation in any prize-related activity) will be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Cleveland, Ohio with respect to any Loss or any other action related to the Promotion.
9. WINNERS LIST: For the names of winners, send a self-addressed, business-size envelope with proper postage affixed before 11/30/08 to: Crisco Grill-A-Day Giveaway Winners List, Dept. 5492, PO Box 5008 Stacy, MN 55078-5008. Winners list will be sent after all winners have been verified.
